Landmark Legal Case
Against PA Midwife
In 2007, the Pennsylvania Board of Medicine ordered
Lancaster County midwife Diane Goslin, to cease and desist
from the practice of midwifery. She had not been accused of
endangering any mother or baby. The Board of Medicine
merely claimed that anyone except a CNM or MD who attends
a birth is in violation of the law.
In April 2008, Diane successfully appealed her case to the
Commonwealth Court. The seven member panel of judges
agreed that she was not practicing medicine without a
license and that the law does not give the Board of Medicine
authority to regulate midwives who are not nurses.
This case has revealed the intention of the Board of
Medicine to prosecute non-nurse midwives in Pennsylvania.
If they are successful, thousands of PA women, many of
whom have no medical insurance, will be deprived of their
freedom to choose homebirth with the attendant of their
choice.
